SETL-45-WITHDRAWAL · Version 2026.11.05
Approved by SMARTEDTECH SL (owner) · Effective 1 November 2026
Scope and statutory rights
This policy covers a direct purchase from SMARTEDTECH SL on imeset.com. The actual supplier and supply type appear before payment. Our services are sold to business customers; the statutory withdrawal right described here applies where a purchase is made by a consumer. It does not replace stronger mandatory rights in the customer's jurisdiction or remedies for defective/non-conforming supply.
Services
For a consumer distance service contract, the ordinary EU/Spanish withdrawal period is 14 days from contract conclusion, subject to the legally applicable rules and exceptions. Tell us of your decision before the deadline by the model form, support@imeset.com or a clear statement to Carrer Agricultura, 16, 1º, 9ª, 08320 El Masnou, Barcelona, Spain. The form is optional. Where early performance is lawful, it begins only after a separate express request. If the consumer withdraws after validly requested early performance, only the lawful proportionate amount for what was supplied is payable. Loss of withdrawal for a fully performed paid service requires the applicable prior express request/consent and acknowledgement; starting alone is not enough.
Digital content and mixed offers
For paid digital content not on a tangible medium, early supply and any loss of the withdrawal right require prior express consent, acknowledgement of that loss and the required confirmation on a durable medium. A download button, preview approval or generic terms checkbox is not the required separate choice. Digital content, live teaching, mentoring, work services and physical goods in a bundle are classified separately. If the legal conditions are not satisfied, do not claim the right was waived.
Goods and dated services
Ordinary eligible goods generally have a 14-day withdrawal period from possession, with the applicable return/refund rules. Goods made to the consumer's specifications or clearly personalised may qualify for the specific exception; that does not remove defect remedies. The goods exception is not a shortcut for personalised digital files. Date-specific accommodation, catering and leisure services may have a statutory exception; only the correctly classified dated supply uses it. Healthcare and other excluded/regulatory supplies need their own rules, not a generic digital-service waiver.
Refund handling
For a valid ordinary withdrawal, refund the legally due amount within 14 days of notice, using the original method unless lawfully agreed otherwise and without a refund fee. For goods, withholding until receipt or dispatch evidence is permitted only where law allows it; disclose responsibility for return costs in advance. Deductions and diminished-value claims must be lawful and evidenced. A nonrefundable commercial rate never removes conformity remedies. The receipt identifies the actual supplier and any separate platform fee. Chargeback, complaint and court rights remain.
Platform-specific application
Each commissioned project has a signed order identifying service, operator, deliverables and price. Links to ecosystem products do not transfer data or activate their terms.
No withdrawal waiver is activated by this statement. Where a purchase needs an early-performance request or a withdrawal-loss acknowledgement, it is asked for separately at the time of purchase. UK-targeted consumer transactions additionally use the UK Consumer Schedule. The statutory withdrawal right applies to consumers only; business customers follow their executed order, subject to mandatory law.
